the year of our Lord One thousand Seven hundred twenty and five
I John Mabee of the Township of Schenectady in the County of
Albany in the province of New York Yeoman being very sick and
weak in body but of perfect mind and memory thanks be given
unto God therefore Calling to mind the Mortality of my body and
knowing It is appointed for all men once to dye Do make and
ordaine this my last will and Testament That is to Say
principally and first of all I give and recomend my Soul into
the hands of God that gaveth and for my body I recomend it to
the Earth to be buryed in a Christian like and decent manner at
the discretion of my Executors Nothing doubting but at my
resurrection I shall receive the Same again by the mighty power
of God and as touching Such worldly Estate wherewith It hath
pleased God to bless me in this life I give devise and dispose
of the Same in the following manner and form
Imprimis I give and bequeath unto my oldest Son Peter Mabee all
and Singular my lands and tenements lying and being on the
North side of the Mohawks river between the Lands of Lawrence
Van der Volgen of the Lands of Col Stevan Grossbeck with all
the priviledges and ________________ to the Same belonging unto
the said Peter Mabee and to his heirs forever paying the rent,
and one hundred and fifty pounds current money of New York to
be equally divided among his sisters and that at or before
Seven years after my decease he to pay but 150 as oldest Son.
Item I give and bequeath unto my Second Son Jacob all and
Singular my estate on the South side of the Mohawks river lying
and being between Jacobus Peck's land and the land of Peter
Vrooman together with houses barns barricks orchards gardens
pastures swamps thereunto belonging or appertaining likewise
all ploughs harrows hoes axes waggons sleys or other utensils
for working on the said Farm except cattle unto the Said Jacob
Mabee and to his heirs forever he or they paying or causing to
be paid unto his Said Sisters the just Sum of two hundred and
fifty pounds current money and that at or before Seven years
after my decease and equally to be divided between his Seven
Sisters my daughters and five Skiple of wheat unto his Brother
Peter towards the rent of his land forever as accknowledgment
being his oldest Brother Item I give to my youngest Son Abraham
Mabee all and Singular that house and lott of ground where he
now lives lying in the Town of Schenectady aforesaid between
the lotts of Benjamin van Platt and the Ministers lott together
with the pasture ground that lyes between the pasture ground of
Harmanus Vedder and the pasture ground of Capt. Harmen van
Slike likewise all the arable land lyeing between the land of
Martin Van ________and the land of Aron Vedder on the south
Side of the road way together with the Swamp or criplebush
thereunto adjoyning unto my son Abraham and to his heirs
forever he or they paying or causing to be paid unto his
Sisters two hundred and fifty pounds current money of New York
to be equally divided among them and that at or before Seven
years after my decease and five Skiple of wheat unto his
Brother Peter or to his heirs forever towards the paying the
rent of his farm and accknowledgment of being his oldest
Brother
Item I give to my daughter Margarett the half of all my lands
where she now lives called Kadoritha during her natural life
Item the other half of the Said land called Kadoritha that
Nicholas Hall hath hired for fifteen years the Said hire to be
divided between my Son Peter and Jacob and at the death of my
Daughter Margarett and the Expiration of the said fifteen years
all my the Said lands and Tenements at Kadoritha to be equally
divided between my Said Sons that my son Peter and Jacob and to
them and their heirs and assigns forever
Item It is my further will that in Six months after my decease
that all my movable Estate goods and Chattels except those
things I have already given to my Son Jacob for the use of the
farm be appraised and equally divided between all my children
that is Sons and Daughters alike not the one more than the
other Item That my three sons that is Peter Jacob and Abraham
pay first all my debts and then enter into Articles for payment
of their Sisters at the Expiration of Seven years as before
mentioned at the Expiration of the Said Six Months in the
presence of my Executors hereafter mentioned and I do likewise
Constitute make and ordaine Jacobus Van Dyke and Caleb Beck
Executors to this my last will and Testament and do hereby
utterly disallow revoke and disannull all and every other
former Testaments Wills Bequests and Executors in me before
this time named willed and bequeathed ratifying and confirming
this & no other to be my last will and Testament In Witness
whereof I have hereunto ____________________this day and year
